November 2019

Paice and the Abell Foundation filed a patent infringement lawsuit against BMW in U.S. District Court in Maryland in Nov. 2019. The litigation against BMW has been stayed until February 26, 2021.

BMW has filed three petitions for Inter Partes Review (IPR) at the U.S. Patent & Trademark Office. The IPR proceeding (IPR2020-00994) challenging U.S. Patent No. 7,104,347 was instituted in Nov. 2020. The IPR proceeding (IPR2020-01299) challenging U.S. Patent No. 8,630,761 was instituted in Jan. 2021. The IPR proceeding (IPR2020-01386) challenging U.S. Patent No. 7,237,634 was instituted on February 5, 2021. The Patent Trial & Appeal Board (PTAB) found all challenged claims unpatentable in final written decisions in all three IPR proceedings. Paice disagrees with the PTAB’s decisions and is appealing to the Federal Circuit.
